Terms and Conditions & Warranty
Information for Consumers on Distance Contracts and Customer Information for Contracts in Electronic Business Transactions
§ 1 Scope of Application
For business relationships between us and the customer, the following General Terms and Conditions apply to orders placed via our online shop in the version valid at the time of the order.
§ 2 Conclusion of Contract
The presentation of our products on our website constitutes merely an invitation to the customer to submit a contractual offer. By submitting an order, the customer makes an offer within the meaning of § 145 of the German Civil Code (BGB). The customer receives a confirmation of receipt of the order by email. The contract with us is concluded when we accept the customer's offer within 2 working days after the order is sent, in writing or in text form. The decisive factor in this regard is the time of receipt of the declaration of acceptance by the customer. A working day is any calendar day that is not a Sunday or a nationwide public holiday.
§ 3 Right of Withdrawal
Consumers have a statutory right of withdrawal. Please refer to our separate cancellation policy for the legal details and conditions, which you can view under Right of Withdrawal. This will also be sent to you in text form (e.g., by email) after completion of your order.
§ 4 Delivery, Shipping Costs, Transfer of Risk
Delivery is made at the shipping costs indicated in each individual case. If the customer is a consumer, we bear the shipping risk regardless of the shipping method. If the customer is a business, all risks and dangers of shipment pass to the customer as soon as the goods have been handed over by us to the commissioned logistics partner.
§ 5 Retention of Title
The delivered goods remain our property until the purchase price has been paid in full.
§ 6 Payments
Only the payment methods displayed to the customer during the ordering process are accepted.
§ 7 Warranty for Defects
The statutory warranty rights apply.
§ 8 Information for Consumers on Distance Contracts and Customer Information for Contracts in Electronic Business Transactions
a) We are not subject to any specific codes of conduct not mentioned above.
b) Any input errors when placing your order can be identified in the final confirmation before sending your declaration of contract and can be corrected at any time before sending the order using the delete and edit functions.
c) Please refer to the individual product descriptions within our online offering for the essential characteristics of the goods we offer and the validity period of limited-time offers.
d) The language available for concluding the contract is German.
e) Complaints and warranty claims can be submitted to the address provided in the provider identification.
f) The contract text is not stored by us and is therefore not accessible to you as a customer after the contract is concluded.
g) Please refer to the offer for information on payment, delivery, or fulfillment.
§ 9 Information on Dispute Resolution Proceedings Before a Consumer Arbitration Board
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Refunds
We initiate any refunds automatically to the account you used for payment. For payments by invoice or prepayment, the refund is made to the account from which the original transfer was made. If you paid by PayPal or credit card, we will refund the amount to the associated account. If you used a gift voucher, we will credit the corresponding amount to your voucher account; please contact our customer service for this purpose.
The return is free of charge for you, provided that you use exclusively the return label provided by us. Please send your package to the address indicated on it. As we use two different return addresses, your shipment can only be correctly assigned and processed quickly without additional costs in this way.
§ 11 Miscellaneous
The law of the Federal Republic of Germany applies to the contractual relationship between us and the customer and to the respective terms and conditions. If the customer is a consumer, the statutory provisions and rights applicable under the law of the state in which the consumer has their habitual residence for the protection of consumers, from which no deviation by agreement is permitted, remain unaffected by this agreement. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.
